We hereby provide steps for Stamping of Conveyance Deed (CD) documents sent by Delhi Development Authority (DDA) along with the Demand-cum-Allotment letter to allottees of the DDA Housing Scheme 2010. This will help consumers to save money which they otherwise would have paid to agents to get this done.
- Verify that the details filled-up by DDA in the first copy of the Conveyance Deed are correct.
- If the details are not correct, immediately bring it to the notice of concerned DDA official.
- If the details are correct, copy the details that are filled-up by DDA in the first copy of the Conveyance Deed in the remaining three copies of the Conveyance Deed.
- Paste passport size photo of the allottee(s) in the space provided on each of 4 copies of the Conveyance Deed.
- Visit DDA office at Vikas Sadan, INA along with the requisite Stamp Duty amount to be paid.
- Collect a File Cover containing Application for Stamping in the name of "The Collector of Stamps", Delhi from outside DDA office which will cost you Rs.20/-.
- Tag the following documents to your file along with the Application for Stamping duly filled and signed.
a) Copy of Demand-cum-Allotment Letter from DDA.
b) Copy of Covering Letter from DDA.
c) Four Original copies of Conveyance Deed duly filled and photograph pasted.
- Please refer to the picture below for necessary documents required to be submitted to "The Collector of Stamps" office as put-up on the notice board outside their office. Essentially there should be total of 7 documents tagged in your file.
- Go to "The Collector of Stamps" office, Govt. of NCT of Delhi located in the Room No. 6, Reception Hall inside the DDA building from 10AM - 1PM only and submit your file complete in all respects with necessary documents and collect a Challan for the payment of Stamp Duty from them.
- Deposit Stamp Duty as per the Challan by Cash/ DD/ Pay Order/ Personal Cheque at the SBI branch in the DDA office itself. Please note the following sub-points in this context.
a) They do not accept more than Rs.50,000/- in cash. If that be the case use other modes of payment.
b) The DD/ Pay Order/ Personal Cheque should be drawn in the favor of "Collector of Stamps, SBI A/C, Vikas Sadan".
c) The best option is to make payment by a Personal Cheque drawn on SBI bank as the payment is transferred to the SBI A/C of The Collector of Stamps immediately and the payment receipt is acknowledged on the Challan there and then.
- Submit a copy of the paid Challan to The Collector of Stamps office after which they will give you a date on which you can collect the Conveyance Deed documents from them which is normally 7days from the date of submission of the documents.
- You are then required to collect the Conveyance Deed documents on the said date by visiting The Collector of Stamps office from 2:30PM - 4:30PM only.

- Stamp Duty to be paid is (Male: 6%; Female: 4%; Joint: 5%) of the amount specified in the Conveyance Deed.

You should pay 5% duty only if you want the property in joint name. Otherwise having spouse name listed on CD does not and should not in any way effect the ownership of property especially when the first allottee is female.

ReplyDeleteWe got to know from some of the Allottees who went for the Stamping Process , that DDA is asking them to add the Husband photo and hence make the case as Joint , though the Allottee is Female.

It seems that Delhi Development Authority (DDA) as per their rules and regulations makes allotment by default only in the joint names of Husband and Wife if the applicant is married even though the application was made in single name.
ReplyDeleteHowever, Wives have an option to choose whether or not to include their Husband's name in the allotment. If they choose allotment in single name it means 1% saving on Stamp Duty however Husbands have to give No Objection Certificate (NOC).
You should stick to your stand of allotment in single name and contest your case with concerned DDA officials which makes perfect sense to us.

It is very strange that demand letters were handed over to HDFC, Bank Kailash Bldg, KG Margh, New Delhi to be issued to respective allottees. We have received demand letter under the covering note from referred HDFC branch signed by authorized signatory to deposit your flat cost at our bank.
ReplyDeleteWhen I gone to deposit DD of another bank they refused to accept. Their request was that " till date we have not received soft copy of allottees from DDA office so that it would not be possible to issue receipt, till then you will have to wait. When I asked persons sitting on counters about all this mismanagement they contacted their senior via land line phone and handed over the receiver to me for listening what he has to say. Unfortunately he had also given the same reply.
I think they are accepting the DD of those allottees who have taken loan from their Bank otherwise they should not have refused to accept by DD.
This matter should be taken up with DDA Nodal officers, if individual allottee protest it is possible that he or she would be harassed, directly or indirectly.
DDA rule in relation to inclusion of spouse name in Conveyance Deed (CD) documents says that to prevent the matrimonial tensions spouse should be made the co-applicant however females may be given the option to include her hasband's name.

ReplyDelete- Go and collect three copies of CD docs. One copy will be retained by the collector office.
- Make payment of the demand amount as per Demand-cum-Allotment letter.
- Prepare documents to be submitted for possession usually referred to as possession set.
- The following documents are to be submitted.
1. Photocopy of Covering Letter and Demand-cum-Allotment Letter.
2. Photocopy of Covering Letter from Bank for making payment of the Demand Amount.
3. Copy of the Demand Amount Payment Receipt Acknowledgement Note from Bank.
4. Photocopy of Bank Passbook duly attested by the Bank Manager.
5. Three Original Conveyance Deeds duly stamped by The Collector of Stamps office.
6. Photocopy of paid Challan of Stamp Duty.
7. Three Affidavits as per Annexure – C, D & E of the brochure of DDA HS-2010 duly executed as mentioned therein.
8. Two Undertakings as per Annexure – F & G of the brochure of DDA HS-2010 duly executed as mentioned therein.
9. Possession Letter in quadruplicate as per Annexure – H duly filled-in and executed as mentioned therein.
10. Photograph and Signature of Self and Husband as per Annexure – I duly attested by the Gazetted Officer.
11. Consolidated Information Sheet duly filled-up.
12. Original Acknowledgement Slip of Application Form duly discharged on the back by affixing revenue stamp and signing it.
13. Photocopy of PAN card duly attested.
14. Photocopy of Election Id card as identity and address proof duly attested.
- Once you are done with this step then wait for possession letter from DDA.

DeleteIf someone has taken a loan for the earnest money and loan for the payment of the DAL Amount, then which Bank Pass Book do we give. AS some banks are not giving passbooks only statements ?
Also, the documents have to be submitted the same day we collect the papaers or there can be a a few days gap in that ? As the Payments for Bank and CD are already made. There is no pendency is payment its made before the due date.

Yes, you can collect CD docs on her behalf however it is advisable to carry authority letter from your wife just in case if they ask for it...Normally, it is required but at times DDA people don't care to ask for it...

Covering letter is precisely what you are referring to.

You have to submit a request in writing to DDA to issue a duplicate Demand Letter and go through the pains of completing formalities as required by DDA.

Stamp duty is charged on cost of land, construction and freehold charges. Therefore amount on your conveyance deed is correct.

DDA is interested in money. They are least bothered about which one comes first.

Well no authority letter is required for submission of CD docs as such but to play safe it is always good to issue authority letter in favor of the person who is going to submit and collect CD docs on your behalf.

I am going to take home loan for the flat which has been approved to me in August 2011. Now, they (Home Loan Bank)told me to obtain Mortgage intimation letter from DDA and submit the same to Bank for disbursement of Loan. Is there any such letter issued by the DDA and if yes, where to contact in DDA office or the same? Can anyone contact the same on my behalf? What documents do i need to submit in order to obtain the Mortgage Intimation Letter from DDA?
ReplyDeleteYou have to intimate DDA about the loan and submit your loan approval application to them so that in return they can issue you a mortgage initimation letter as req. by your bank.

My original acknowledgement receipt of 1.5 lac is misplaced by the bank and bank has issued me a certificate in this regard which I have submitted to dda at the time of verification of the documents. now I have to depoit the final payment as per demand letter and the original acknowledge receipt has to be submitted along with other required docs. ReplyDeletePlease specify clearly in the documents that you submit to DDA explaining the entire thing in great detail and clear terms and also attaching the original certificate of the bank.
DeleteYou may also like to check with them if any other formality is to be completed in this respect so that you can include it in the possession set.
Please take this pain otherwise you may ultimately end up receiving a query from them say after a couple of months much to your pain and agony.

As I have just came to know from the posts that for a female its not mandatory to make the spouse as co - owner (though an NOC from husnband is required). However in case my husband wants to be a joint owner (for that stamp wud be 5%)...do you know the process of adding the spouse name to it? Also is that the only requirement to make the property in joint name?

I suggest you approach your dy. director for inclusion of your spouse name as the joint owner with all relevant proof of marriage such as invitation card, marriage photo etc if you haven't registered your marriage yet.

In the interest of time (considering 27th June as the last date for submission of all the docs with DDA incl. CD), would it be a viable decision if we carry on with the single status as is.

See, you have to submit affidavit regarding your matrimonial status as part of the possession set.
DeleteIf you maintain your status as single effectively you will be submitting a false affidavit which may result into issues later on and DDA folks as you very well know hardly miss an opportunity to make money. So please be careful.
If the marriage cert is not there, i believe invitation card, wedding photo or some other proof of marriage should be ok. please ask your dy. dir. for the documents req. in lieu of marriage cert.

ReplyDeleteMe and my brother are joint allottees of DDA flat where I am married and my brother is unmarried. In the conveyance deed I have my wife's name as well. What is the stamp duty I will have to pay, 5% or 6%?

According to us it should be 5% but DDA folks know better as they have their own rulebook.
DeleteIn case my husband has taken NOC without my willingness for conveyance deed and he had pay 6% of stamp duty then I had also submitted the application for void the NOC. Then can he make the conveyance deed or not. plz. suggest.
ReplyDeleteIf you have submitted application to void your NOC before execution and registration of CD, you are safe.

We suggest you say YES to that question.
DeleteYou don't have to provide any details to Income Tax dept now. You may submit details about the same if at all required when you fill-up the income tax return of the allottee.

I got partly opened one normal post letter “for execution of convinces deed”. This 1 page letter specifies what needs to be done for CD execution (around 10 points). Execution date they have given is of Jan 13, But where is 1% amount mentioned that i will have to pay at time of registration/execution? Where is CD (yellow long paper).Is there any thing missing? .Pl help. regards skumar

ReplyDeletei have a flat mutated in my name after my fathers death. it was old 1970s alloted LIG on hire purchasse with a perpetual lease deed. so i tried to get it freehold. since i live overseas, i hired a local agent. now he hass filed and is asking me to stamp the conveyance deed and register, so far I have not seen the original CD in person. Is there any chances of fraud, can he do any mischief on these documents, the original papers of house inclu the perp lease executed by my father are with me. Pls advise as in DDA its been a mess and agents seem to hold the powers.
we suggest it is safer that you verify owner details listed in conveyance deed before you go in for stamping.
ReplyDeletewell the risk is not much at this point as the freehold process cannot be completed without your presence in person as your signatures are required on the conveyance deed and other formalities have to be completed for getting it registered.
I am a member of COOP Society and recieved 4 Copies of CD in green colour one is filled up but full name has not been mentioned by DDA although covering letter is in full name. Do i have to paste photos of my wife also and her signatures attested by Gazetted officer. What process is to be followed for getting CD stamped from collector of stamps. pl write the process if different from non coop society allottee.

Flat is on my wife's name. We have received the call for doing the CD on April 16th. Is it necessary for me to accompany my wife to DDA office, am I required to sign etc? I am in Mumbai and would have to specially come for this. Don't mind coming but want to avoid if I am not really required. thanks in advance!

If the flat is in joint name with spouse both of you need to be present on the designated day for the execution of CD.
DeleteYou can write an application to the concerned housing dy. dir. requesting a new date for CD execution. That should be sufficient.
My father was allotted a DDA SFS flat and a few years later added me as a co-allottee of the same flat. Recently he applied to get the flat converted from lease hold to free hold, but the Conveyance Deed that was issued was based on the original allotment to him and is only in his name. In this regard I am seeking answers to the following questions:
ReplyDelete(1) Should the Conveyance Deed have been made in the joint names or my father and me?
(2) Given that the CD is issued only in my father's name, do I still remain a co-allottee of the said DDA flat?
(3) Does any remedial action need to be taken with regard to the above?
1) CD should have been in the joint name(s) i.e. you and your father.
Delete2) You are still the co-allottee but the same should appear on CD document.
3) You need to contact appropriate property dept. in DDA for the necessary correction on CD document.
Thanks a lot for the reply. I have a few follow-up questions:
Delete(a) Is there a stipulated time period within which the CD needs to be corrected?
(b) If the CD remains uncorrected, will it in anyway affect my joint ownership of the DDA flat? The reason for asking is that I live abroad and cannot come to India frequently to chase after DDA officials who are known to be difficult to get hold of and very slow to act. My father is not keen to pursue a correction because of the above reason and also because he strongly beleives that the CD in his sole name does not affect my joint ownership of the flat. Since my father is quite old I don't want to put him through additional stress of dealing with DDA bureaucracy, but at the same time I don't wish to jeopardise my joint ownership of the flat and risk conflict with siblings over the same. Your advice would be much appreciated.
Your joint ownership technically is not affected however your name missing from CD will lead to hassles for you anytime you need to prove your joint ownership of the property.
DeleteThere is no time period as such for correction however we recommend sooner the better.
You can engage an agent who will get the necessary done for a fee.

No you are not required to sign the CD docs. All you need to do is to verify the details filled in the CD docs... Signing is at the CD execution stage...

You need to provide authority letter. Sometimes they get fussy and insist on it. The authority letter should be on Rs. 20 stamp paper and the authorised person should carry your as well as his id proof.

I have already paid the required the stamp duty at the same time 6% can my wife still withdraw the NOC and clam joint ownership of the flat. Is the CD will be in my name as it has not been executed so fare.
As the CD is yet to be executed and registered, she can still approach DDA and withdraw her NOC and claim joint ownership in CD...
