Subject: General Power of Attorney - missing

Description: Dear Sir,

I wish to purchase a residential property, located in Bangalore. The details of the Title flow is as follows:

Here below please find the list of transactions to give you a brief of the flow of the title deeds:

1) One Muninanjappa owned the following lands in Horamavu village:
a) Survey No.91/1 - 2 acres 32 guntas
b) Survey No.91/2 - 0 acres guntas
c) Survey No.91/8 - 0 acres guntas

Upon his death, the legal heirs Smt. Anjanamma (wife), Shri Narayanamurthy(son) & Shri Venkatesh(son) have got the khatha changed in the revenue records (RTC, Mutation) during the year 2006-2007

2) The legal heirs mentioned above have through Notarized GPA alienated the schedule property to one Shri Harikrishna during the year 2004. GPA Copy not available with the Vendor Shri Ravinder Challa.

3) Shri Harikrishna vide sale deed 14695 of 2006-2007 dated has sold/alienated the schedule property to one Shri Anandanarayan.

4) Shri Anandanarayan vide sale deed 191 of 2009-2010 dated has sold/alienated the schedule property to one Shri Ravinder Challa (Vendor). This sale deed has been witnessed by the legal heirs of the ORIGINAL land owner(Smt. Anjanamma, Shri Narayanamurthy and Shri Venkatesh)as consenting witnesses.
(So even in the absence of the GPA in favour of Shri Harikrishna hope the flow of title would be correct)

5) Shri Ravinder Challa (Vendor) has during the year 2011 developed the property by building Ground, First and Duplex second floors. He has paid all the taxes upto date and obtained B Khatha ( Certificate of Property Register Extract) from the BBMP authorities, though the said land in survey No.91/1 has been converted for residential use by the Deputy Commissioner.
Please note that the Vendor Shri Ravinder Chall has availed a housing loan on the said property from IDBI Bank, and the GPA has not been deposited with the Bank for deposit of title deeds and creating a mortgage.

Please advise me whether in the absence of a Notarized GPA as stated above, and the legal heirs of the original land owners having consented to the transfer of property to the Vendor Shri Ravinder Challa by subscribing their signatures as consenting witness, could I go in for purchase of the property. I shall be highly obliged to receive your reply at the earliest.

  1. It could be tricky and without proper scrutiny of legal documents we are not in position to comment.

    However, one question that you need to find an answer of is how the legal heirs are the witnesses on the sale deed. It seems the entire chain of transactions is between one group of known people. All we are suggesting is to be cautious and stay away if you notice anything shady as it is too much problem once you take plunge into anything non-viable.
