Subject: regardig AGPA SALES

Description: SIR, i would like to take a property from a builder having agrement of sale cum GPA on his name registered in registrar office in2004 and it has come in EC.NOW HE WANTS TO SELL THAT PROPERTY TO ME. I AM INSISTING FOR SIGNATURES OF BORT LAND OWNER AND BUILDER BUT BUILDER SAYS OWNER WILL SIGN AS WITNESS ONLY AND HE SAYS THAT IF OWNER SIGNS IN REGISRATION THE DOCUMENT IS NOT VALID.
CAN I TAKE DIRECTLY FROM THAT agpa which is registered with signature of owner as witness. as there is no sale deed in between them , will it not be affected bu SUPREME COURT JUDGEMENT IN suraj lamp case. pl suggest me sir.

  1. You can buy from builder if he holds a valid Agreement to Sale and GPA from the property owner. SC judgement is no hindrance.
