Submitted By (Submission ID): Innocentia Mompe from South Africa (54552787)
Product / Service Provider Name: Vodaco
Subject: Irrepairable phone
Description: I upgraded on the 10 /12/10, in May my phone was damaged n the problem was I could not operate the touch screen only the buttons, I sent to vodacare (City Mall/ Klerksdorp) I requested for a loan phone since I did nt have a phone n was told phone were broken and they cannot help *Total inconvinience*.

Then my phone to Potchefstroom and was told it was liquid damaged and had to pay around five hundred before they fix it. I went to Klerksdorp and pay the amount quoted, a week later it was returned n not fixed , I had to take back again and still no loan phone.Potchefstroom then send my phone to Johannesburg and they sent me and indemnity form that say I allow them to repair my phone and my waranty was cancelled and it was only then that they explain the possible cause for a phone being liquid damaged and its funny that my phone came with a pouch and was always in a pouch, I signed since I needed the phone, after no one called about the status of repairs.Had to follow up and was send from one shop to another*pissed*. after a month I got it back n had to pay again, It could not charge with a normal charger n had to use the usb able n it did not charge fully, I took it back to the shop and was told that I had to buy a new charger, dit that and it would freeze ater ch!
erging and later on it went blank.

I took it back to the shop it was send back to Potchefstroom then to Johannesburg n it was send back n was told it was beyond economical repair and they cant do anythingt about and if I have insurance I should claim from them. , I honestly cant pay for the phone that is not working at all.I really need to be compensated or be given a phone.or else I should cancell my contract with vodacom I mean the phone is hardly a year old and Ive signed a two year contract

The service at the shop is so bad and Im dissappointed , the only time you get a good service is when u take a contract but when u have a problem they give all sorts of excuses. Ive been a loyal customer to vodacom for many tears but ith the service Im getting Im thinking of taking my business else where.

Im now in contract with another service prvider since I was desperate to have a phone n I cant be having so many cell phone contract.

  1. Dear Consumer,

We currently do not have tie-ups in your country but can assure you to have some in no time going forward to help disgruntled consumers like you. Till then we kindly request your patience.

However we can still suggest some generally applicable actions that may help you to resolve your grievance ASAP.
    - if you have lost all hopes of an amicable resolution with product/ service provider then stop accepting any requests to fix the issue from them and make it absolutely clear to them that you are no longer interested in their product/ service and want acceptable and commensurate compensation for the extent of damage caused including and accounting for all the pain that you had to go through in the process.
    - the best way to deal in such matters is to provide 10days written notice to product/ service provider by a registered post describing in detail the entire dispute and making it absolutely clear to them that if an agreeable resolution is not reached within the said notice period of 10days then you will be forced to take punitive and enforcement action against them.
    - you may also like to indicate what you are looking for in terms of compensation to settle the dispute amicably.
    - specify in your notice itself one and more possible actions which you can and intend to take such as:
-- filing a complaint with consumer court to recover financial loss.
-- filing a complaint with regulatory authorities for appropriate action for the deficiency in product/ service.
-- filing a complaint with local authorities/ governing bodies to take note and appropriate action.
-- filing a complaint with consumer welfare organizations for taking note and appropriate action.
-- registering a complaint with online consumer forums for taking note and appropriate action.
-- spreading the word on internet, social sites and by word-of-mouth to alert other consumers.
    - mostly it is seen that the grievances are resolved expeditiously after such a notice is sent and the same can be expected in your case.
    - however, if this doesn't work then you have no choice but to take legal action against them.

You may also note that we share information on topics of common interest to consumers worldwide on regular basis.
