Subject: Request for refund of money on termination has not been accepted.
Description: I am having a dish tv connection for the past few years. My customer id is 01501562243.
Since the last 2 months (end April 2011 onwards) I am having very disturbed reception of the channels. This disturbance is happening mostly in the evenings. On my complaints, the Dish TV technicians have visited at least 5-6 times during the past month and changed a few parts, but have not been able to fix the problem permanently. Now I have stopped calling them since the past 2 weeks as they are not able to solve the problem and therefore I am not able to watch any programmes in the evening.
I have informed the Dish TV customercare vide e-mail dt.22.6.2011 that I would like to terminate my connection. Apart from the security deposit, I have paid Rs.3555 as subscription for the period 16.3.2011 to 11.3.2012.
I have requested them to let me know what amount will be refunded to me if I were to terminate my connection and how this money will be remitted to me.
As a result of my mail I got a call from them saying a technician would visit the evening to correct the alignment problem. However, there was no visit.
On 23.6.2011, I again sent a mail saying I did not want a technician visit as they were not able to solve my problem in a permanent manner. I once again requested information on what amount was payable to me on termination.
Against this mail I got a call from customer care on 28.6.2011. I spoke to Mr. Amit who is a supervisor. But since my problem is a recurring one I requested to be put through to someone at a senior level. i was put through to Mr. Sunny who is a Senior Supervisor. I conveyed to Mr. Sunny that I wanted a refund of the balance money as well as the security deposit as I was not getting the services for which I had paid. Another fact is that although I have renewed my AMC on 24th April 2011, I have to repeat this information each time I talk to them as they have not updated this information in their records.
Mr. Sunny offered to solve the problem but I told him that i was not willing to pay for any change in the antenna position as it had been fixed by the technicians and it was not my fault that they had placed it at a not very good location. Mr Sunny assured me very strongly that he would get back to me within 3 hours on changing of the antenna position free of charge. But it is 3 days now and he has still not got back.

I request your help in getting back the unused subscription money as well as security deposit from Dish TV.

- that you have not been able to enjoy watching tv since end april'2011.
- fault has not been fixed by dish tv technicians predictably in expeditious manner thereby leaving you with a bad taste for them.
- you have already given them plenty of opportunity to fix the issue but to no use.
We suggest the following actions that may help you to resolve the dispute asap.
- if you have firmly made up your mind to discontinue their services, do not entertain any requests from them to fix the issue and make it absolutely clear to them that you are no longer interested in their services and want your refund of subscription money and security deposit ASAP.
- we suggest that you ask for refund of subscription money from the end of april'11 onwards.
- the best way to deal in such matters is to provide 10days written notice to them by a registered post making it absolutely clear to them that if the issue is not resolved appropriately you will be forced to take punitive and enforcement action against them and will file a complaint against them in the consumer court.
- mostly it is seen that the issues are resolved expeditiously after such a notice is sent and the same can be expected in your case.
- however, if this doesn't work then you have no choice but to take legal action against them and for which you may contact us separately if the need be.
