Complaint No. 49535997 against HDFC Bank Credit Card registered by Akhileshwar Dhiman dated 25 May 2011

Subject: Charge Dispute
Description:
At merchant site I used my HDFC Bank Credit card. But there was an issue with the machine and Merchant swiped Credit card for 6 times and there were no receipts generated for the transactions. Hence I paid the amount by Cash. I contacted the HDFC Bank customer care and narrated the same on the same day. They confirmed me that in case they will not receive any transactions receipts from the merchant they will not charge the same. Now the Bank charge the transactions to my statement.

  1. you should go to the merchant and tell him that you have been charged twice by mistake and the same should be refunded to you. In 90% case that's the end of it but if for some reason it doesn't work then you have to file complaint within the banking regulatory framework.

  2. I contacted Merchant and filled the Charge dispute form also but nothing is going my way. The bank is asking me for the proof of Cash payment and below is the reply I posted to HDFC Bank :

    Sub : In response to query number 11133133370
    Dear Sir/Madam,
    With due respect I state that the said transactions on 5th March 2011 are invalid as there were no transaction receipt generated and I didn’t signed any receipt. I filled diesel of Rs 500 and used my HDFC Credit card ending with xxxxxxxxxxxx5925. There was an issue with the machine as not generating the receipts . The merchant tried many times but not succeeded. Hence finally I done the payment by cash.

    For the above I have the following points :
    1) I called up HDFC customer care at the same time using mobile number 9953307902 and stating the issue to them that merchant swiped 6 times my credit card and they confirmed me that in case the HDFC bank will not receive any signed receipts then they ignore/drop the transactions.
    You can trace the call made by me on the same day to the customer care.

    2) In case I need to fill diesel of Rs 3000(as total of 6 transactions) then why should I go for 6 transactions of Rs 500 each instead of single transaction of Rs 3000.

    3) If the transaction was of 5th March 2011 then why the merchant /other Bank claimed on 27th April 2011. And do they have signed receipts for any of the transactions ?

    4) The Merchant himself is a retired Defence Officer from Air Force, hence I trusted him as he ensured me that he will revert the amount in case he received the same in his account. That is why I mistakenly not taken any receipt of Rs 500 taken by him as a cash. Also HDFC customer care executive confirmed me that in case there is no signed receipts of the transactions they will drop the transactions.

    This is all I have to say. It is my humble request to look into the issue and enquire about my calls to customer care with mobile number 9953307902 on 5th March 2011 around 2:30 p.m. I am sure you will get handy information as the calls are recorded.

    Also rather asking me for the proof for the cash payment you should ask for the signed receipts of the transactions from the other Bank as a proof. I guarantee you in case other bank provide my signed receipts(Merchant copy) as a proof , I will pay the amount.





    I hope I will get response in positive manner else I will go to Consumer court for the fraud and harassment case as it seems that there is no other work around.

  3. you should take-up the matter with merchant as the money has already paid to him by the bank and he should ideally refund it to you. You should submit your complaint to him in writing stating all facts and give him a notice of 10days after which you can file a complaint against him and the bank in consumer court.

    It is ok to continue follow-up with the bank as you are doing it. You can also go to the banking ombudsman with your complaint. Please follow the link at the bottom of our website.
