Subject: can a GPA holder register the property to 3 person

Description: Hello Sir,
I want some help with regards to my Dad's property in Bangalore.
We have bought the land in 2003. The land is A-katha. One of our long term family friends had difficulties so we offered them to stay in our land for free of cost at the same time there is someone in the property. We have not made any agreement, they were living for free. All taxes are paid by my father name who is the owner of the property.
Now when my father wanted to sell the property, we were informed by the family staying our land that my father has given a GPA in Feb 2011 for a sum of 8lacks under a notary public. My father has not done any GPA and he has not received any money. GPA was only made for half the property.
Now in Jan 2014, the GPA holder has sold the property to her son and made a legal registration holding the GPA.
My father's original Absolute sale deed is also missing.
I want to know
1) How much are the GPA document legal?
2) Registration made between the GPA holder and her son? Is it valid?
3) How do we challenge the GPA document?
4) EC as of last week property is not transfected.
5) What should I do.

  1. You need to file legal case against the person who claims that the GPA was executed in his name by your father for Rs. 8Lacs for committing forgery. In the court it is to be proved that the GPA is forged and should be invalidated. If you can prove that you can get your property back.

    About the missing sale-deed, you can get the certified copy from the registrar office. Your father has to approach the registrar office himself and in person.
