Subject: Problems with used vehicle dealer
Description:
I purchased a VW Citi Golf from a dealer in Klerksdorp. Took delivery on Saturday 9/4/2011. On the sunday we realised there were a few problems. Took the car early Monday 11/4/2011 to another dealer who found the car had numerous problems. We wanted to cancel the deal. Dealer said we should do a replacement deal, otherwise he was going to deduct R3000.00 from our deposit. I eventually took the car the the AA for a techical inspection which confirmed car was in a serious accident. Dealer still refused to cancel the deal. I then had to consult an Attorney who managed to resolve the issue. I eventually received my deposit but in the process had to spend +/- R3400.00 (technical inspection and legal costs). My question : Why did he not simply cancel the deal as per the new Consumer Protection? Secondly, why did I had to spend so much money to cancel the deal? Do I have any chance of getting this money back without having to spend an additional sum of money?

  1. your attorney should have included the cost of tech inspection and legal fees to your initial deposit while filing for claim from the dealer. The only option you have now is to file again for these charges including the legal fees to be incurred this time.
